Terra Supreme, Inc. (“Terra Supreme”, “we” or “us”) makes available the Terra Supreme application (the “App”) in the United States via the Apple App Store and Google Play Store. This Privacy Notice describes how we collect Personal Information (defined below) and data when a user (“you”) uses and interacts with the App and any Terra Supreme websites including terrasupremebattery.com (the “Sites”).

By using the App, you consent to this Privacy Notice and agree that we may collect, use, retain, share, transfer, and otherwise process your Personal Information as described in this Privacy Notice.

I. Information Collection
When providing our App, Terra Supreme may collect data, including Personal Information, about you. “Personal Information” means information that can reasonably be linked to a particular individual or household or as otherwise defined by applicable data protection laws. The Personal Information we may collect depends on your level of engagement with the App.

Sources of Personal Information Collection. We may collect Personal Information from a variety of sources, including directly from you and your interactions with our App or Sites. We may also obtain information about you from other sources, including through third-party services.

The Personal Information we may collect includes:

Identifiers. We may collect identifiers when you voluntarily provide them to us through your use
of the App or our Sites. These include:

• First and last name
• Phone number
• Physical address
• Email
• Information from communications
  • We collect information you provide to us in communications, such as through customer support or our chat services
• Any other identifiers you provide to us

Technical Information. We collect technical-related data and Personal Information when you use
our App, including:

• Information about how you use the App
• Precise geolocation of your devices that host the App
• Full IP address of devices used to access the App
• Device ID of devices used to access the App
• Wi-Fi network information

Battery Information. The App is designed to function with, and monitor, your Terra Battery
EBM Battery. To use our App, you must connect your EBM Battery to the App by following
the instructions provided when you purchased the EBM Battery. When connected, the Terra
Battery EBM Battery will monitor and allow the App to collect:

• Serial number of the battery
• Battery voltage information
• Temperature information
• Warranty information
• State of Charge Percentage (SoC%)

II. Use of Personal Information
Terra Supreme may use Personal Information for a variety of purposes, including to:

• Manage our business and provide our App. Terra Supreme may use Personal Information to facilitate usage of the App, assist in trouble shooting issues with your connected batteries and to provide technical support, improve our App and batteries, engage in research, and as otherwise needed to manage our business.
• Communicate. Terra Supreme may use Personal Information to communicate important business information, including delivering notices to you about the use of our App, your battery, or otherwise relating to our business. We also use Personal Information to respond to your queries and to requests from our business partners.
• Protect our business. Terra Supreme may use Personal Information to protect against fraud, unauthorized transactions, and other risks or liabilities, and to secure our App by identifying potential hackers and unauthorized users.
• Ensure security and efficiency and comply with the law. We may use Personal Information for other purposes with your consent or where permitted by law, for example, to comply with applicable legal requirements, court orders, legal proceedings, document requests, industry standards, and our internal policies.

III. Disclosure of Personal Information
We may disclose your Personal Information in the following ways and circumstances:

• With our service providers and vendors. We may transfer all or a portion of your Personal Information to our service providers who help us deliver our App, our services, and our EBM battery for the purposes described in this Privacy Notice, such a providing technical support. We require that all service providers and vendors follow our security standards and policies.
• For a merger, acquisition, change in ownership, or reorganization. Personal Information we have collected may be disclosed to a third party in the event of a merger, transfer of ownership or assets, bankruptcy, or other corporate reorganization of our company.
• When we are legally permitted or required to do so. Terra Supreme may disclose, without your prior consent, any Personal Information about you or your use of our App, if we believe disclosure is necessary and permitted under law, or required by law. For example, we may disclose Personal Information to:
  • Protect and defend the rights, property, or safety of Terra Supreme, employees,
    other users of the App, or the public;
  • Respond to a legally valid request from a competent governmental authority;
  • Respond to claims that any content violates the rights of third parties;
  • Correspond with law enforcement agencies, if we are required to do so; and
  • Satisfy any applicable law, regulation, or legal process.

Your Privacy Rights & Options
Rights under State Laws. Certain states in the U.S., including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (or will in the future provide) their state residents with rights related to their Personal Information. Some such rights apply generally, but certain of such rights will only apply to a limited set of individuals or in limited circumstances, depending on a person’s jurisdiction of residence. To the extent that these laws apply, you may exercise the following rights:

• Right to Know and Access Information. Note that much of the information you are entitled to know or access is disclosed in this Privacy Notice. With that said, you have the right to know about our Personal Information processing practices. You also have the right to know and access the categories of Personal Information we collect, with whom we share or sell that Personal Information, and, in some cases, what specific Personal Information we associate with you (if applicable).
• Right to Data Portability. If you request a copy of your specific Personal Information, then we will provide it in an easily accessible format.
• Right to Deletion or Erasure. You may request that we delete the Personal Information we have collected about you. Depending on the applicable law, in some cases we are required or permitted to retain your Personal Information, even if you validly request that we delete or erase it.
• Right to Correct Information. You may request that we correct or rectify any inaccuracy in the Personal Information that we have collected about you.
• Right to Opt-out of Targeting Advertising, Sales, or Profiling. You may opt-out of our use of your Personal Information for targeted advertising, sales, or profiling in furtherance of decisions that produce legal or similarly significant effects. Please note we do not engage in these activities at this time.

Appeal. If we deny your request relating to your Personal Information, you may have the right to request an appeal of our decision, depending on your state of residence. To initiate an appeal, follow the instructions provided in the communication denying your request, or contact us using the contact information provided in this Privacy Notice.

Non-Discrimination. You may have the right not to experience discrimination by us for exercising the rights listed in this section, depending on your state of residence. What we mean by discrimination is denying you access to our App or limiting the quality or functionality of our App based on your exercise of privacy rights to which you are entitled.

Email communications. You may control how you receive certain types of email communications by unsubscribing using a link within the body of the communication. Note that some messages are required, including Service-related messages such as transaction confirmation messages, legal notices, or updates to which you may not opt-out.

IV. Third Party Products or Services
This Privacy Notice applies only to our App and Sites. Our App or Sites may contain links to third party products or services including those that permit online transactions, such as purchases. We have no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or other third parties we link to from our App or Sites. Terra Supreme does not endorse, approve, or certify these other products or services, and we do not guarantee the accuracy, completeness, efficacy, or timeliness of the information contained on or provided with such products or services. You should check the applicable Privacy Notice of the applicable third- party service provider when linking to other services.

V. Information Retention, Accuracy & Transfers
Terra Supreme uses several criteria to determine how long we should keep categories of Personal Information. We may retain your Personal Information for the time period reasonably necessary to achieve the business purposes outlined in this Privacy Notice to the extent permitted by applicable law. Terra Supreme is under no obligation to monitor or delete information uploaded to our App by you or other users beyond the scope required by applicable laws.

Please understand that residual copies of Personal Information can be stored in locations or formats that make complete erasure extremely difficult. The best way to ensure you control your information is to give us only the Personal Information that you are completely comfortable sharing with us.

VI. Security
Terra Supreme takes reasonable steps to secure your Personal Information. We maintain physical,
electronic, and procedural safeguards designed to achieve that any Personal Information
maintained is stored and processed responsibly. However, no internet transmission is ever fully
secure, and we cannot guarantee that information transmitted via our App will always remain
confidential.

VII. Changes to Privacy Notice
We may update or change this Privacy Notice from time to time. We will post the changes on the
page this Privacy Policy appears will indicate the effective date. We may choose to notify you by
email of material changes. Your continued use of App after the changes are effective constitutes
your acceptance of the Privacy Notice as so updated.
